I lol'd. Evolution is a theory about the origin of the universe.

I think we can safely say that they have no idea what they're talking about. They don't misunderstand or misrepresent evolution, they just don't know what it is, even in the broadest sense.

I am far from being a lawyer, but it seems to me that at present they have merely expressed an opinion that probably violates the requirements for the separation of the church and the state in a way that most people likely regard as not court-worthy. If they continue in what they consider a logical fashion, at what point would they be doing something that would open themselves up to being taken to court?

On a serious note, I was reading an excellent article on teaching evolution through open inquiry while managing time constraints in the classroom*. The instructors had asked the students to describe evolution in their own words in an essay, and whether or not they accepted it. The students responses were kept anonymous and were presented to the class only as percentages - "8 percent of you have confused evolutionary theory with the Big Bang theory - here is the difference" to avoid embarrassing the students and to show them that they were not alone in having misconceptions. This quote surprised me:

So, a little hope!
